Terms of Services
I, THE UNDERSIGNED, ACKNOWLEDGE THAT BY PARTICIPATING:
I HEREBY WAIVE my right to commence any legal claim resulting from any injury or loss that may occur to myself at the premises.
I FURTHER ACKNOWLEDGE that if I am a parent or guardian of any child participating, I am waiving the right to any legal claim resulting from injury to the child, or the loss or damage of the child’s property while attending.
I UNDERSTAND that there are inherent and significant risks associated with the participation in athletic activity, karate instruction, practice and training sessions. I am aware that those risks include but are not limited to the potential for serious personal injury caused by any event, or condition of the facility or equipment where the athletic activity, karate instruction, practice and training sessions are being held, and health risks such as transient light-headedness, fainting, abnormal blood pressure, chest discomfort, muscle cramps or soreness, and nausea. I understand that the risks are relative to the participants state of fitness (physical, mental and emotional), and to the awareness, care and skill with which they conduct themselves while participating in athletic activity, Karate instruction, practice and training sessions.
I ACCEPT FULL RESPOSIBILITY for all risks and possibilities of personal injury, death and property damage or loss resulting from the participation in athletic activities, karate instruction, practice and training sessions. I agree that although ISK has taken steps to reduce the risks and increase safety of the athletic activities, karate instruction, practice and training sessions, it is not possible to remove all risks. I accept these risks and agree to the terms of this waiver even if ISK is found to be negligent or in breach of any duty of care or any obligation to the participants participating in the athletic activities, karate instruction, practice and training sessions.
I ACKNOWLEDGE on behalf of the participant, the obligation to immediately inform the nearest faculty member if he or she feels any pain, discomfort, fatigue or other symptoms experienced during and immediately after participating in athletic activities, karate instruction, practice and training sessions. I understand that the participant may stop at any time, and may be asked to stop by a faculty member who observes any symptoms of distress or abnormal behaviour.
I HEREBY RELEASE ISK, its teachers, volunteers, coaches, all competitors and participants of any potential claims or causes of action resulting from participation in instruction, practice and training sessions.
I ACKNOWLEDGE that this release is binding on me and my estate in the event of my death.
I UNDERSTAND that is I am signing this waiver on behalf of a child for whom I am parent or for whom I am legally responsible, I am waiving the right to any legal claim on behalf of that child and any other person who is a parent to the child or is legally responsible for the child. I agree and guarantee that that no legal claim or demand will be made by the child or on behalf of the child. If such an event does occur, I understand that this waiver will be used to fully indemnify the Releasees and will act as an estoppel for such a claim.
I FULLY UNDERSTAND the terms stated herein and acknowledge that I accept this waiver of my own free will.
